Capital Punishment for Rape



Might sound a cliché topic “Why this again?”  .

“Until someone screams in our ears, we conveniently choose to ignore [‘them’][1]”- Till the time any of our near and near ones or we ourselves face a heinous act (god forbid), we barely care about what’s happening in our society. And the maximum we do is to write a post on social media and blame the ‘system’ or spare some time thinking about what we can do as a civil society. Numerous articles and blogs- matter of only a few days, again the same continues. We think that whatever steps we take (if any) will be futile and there will be ‘no gains’; rather, we think why ‘waste’ our time and focus on our own lives/ careers instead, notwithstanding whatsoever we read or write.

Approximately every 16 minutes, one woman is raped in India- only official statistics!!![2]

In his book ,“When Crime Pays: Money and Muscle in Indian Politics” Milan Yadav [3]critically examines the impact of money and muscle power on crime rates.

Rapists roam free ‘out there’, whereas the victims are always are barely able to forget that ‘trauma’.

No one expects ‘you’ (every Indian) to put up a strike etc., but what is expected is play your part in modifying/ curbing those sexist comments, rape mentality “The girl might have signaled him.” Harsh, but truth!  Pause for a moment and introspect, how would 'you' have felt if this had happened with any of ‘your’ near and dear ones. No words to express - social stigma, pressure, depression etc. etc. etc. the list goes on and on. These are just words, but ‘that’ horrific incident cannot be aptly captured by any word of any of the languages. The ' I don't care ' mentality will is one which ultimately leads a society and its values to perish. Crimes are not against an individual only, but also against the whole society- its values and its integrity and instills fear in the minds of a 'common person'. So a rapist or a murderer is not guilty for just one person, but against the whole society and by taking it lightly, we are also disrupting the social fabric, which might in turn someday backfire on 'us' with a much greater intensity.

Provided the concurring attitude towards any crime, even laws are easy to manipulate - finding loopholes in the procedure of investigation, planting witnesses etc. are some common routes. The undue benefit of doubt leads to the common man doubting the system and leads 'him' into a state of utter despair. Sometimes, even bribes are given to 'hush up' a crime. So, the fault lies with those who facilitate and commit such acts along with people like me and you, who conveniently choose to ignore the same. 

Laws are there for justice, not for manipulation. All those who actively manipulate or ignore the same need to be sanctioned. This “sanction” has to be stringent, else it actually doesn’t count to an 'actual criminal.

  2. Yes this is not cliché its a fact it should be implemented as a young aspiring law student I withstand with this article that capital punishment is necessary we in India follow reform theory from that perspective this is the best punishment

    Strengthening forensic capabilities and ensuring evidence is collected properly can help with quicker convictions, which can act as a deterrent to potential offenders.
